2. Subject Matter and Duration

This Agreement governs the processing of personal data in connection with the use of Schooling.com for video conferencing, online education, and communication. Processing shall take place for the duration of service usage.

3. Nature and Purpose of Processing

• Provision of audio, video, and messaging services
• User account management
• Ensuring platform functionality and security

4. Categories of Data Subjects

• Students
• Teachers
• Administrators

5. Categories of Personal Data

• Name
• Email address
• Usage data (e.g. IP address)
• Communication data (chat)
• Audio and video data (during live sessions only)

6. Obligations of the Processor

• Process data only on documented instructions
• Implement appropriate technical and organizational measures
• Ensure confidentiality
• Prevent unauthorized disclosure

7. Sub-processors

The following sub-processors are used:

• Agora (real-time communication infrastructure)

8. International Data Transfers

Data may be transferred outside Switzerland or the EU where appropriate safeguards are in place.

9. Technical and Organizational Measures

• Encrypted transmission (HTTPS / WebRTC)
• Access controls
• Authentication mechanisms
• Protection against unauthorized access

10. Assistance Obligations

The Processor shall assist the Controller with:

• Data subject requests
• Data breaches
• Compliance with legal obligations

11. Data Breach Notification

The Processor shall notify the Controller without undue delay in case of a personal data breach.

12. Deletion and Return of Data

Upon termination of the service, personal data shall be deleted unless legal retention obligations apply.

13. Audit Rights

The Controller has the right to request information and conduct reasonable audits.

14. Legal Basis

This Agreement is based on applicable data protection laws, including Swiss law and, where applicable, the GDPR.

15. Final Provisions

• Amendments must be made in writing
• Swiss law shall apply
